The present Terms and Conditions of Sale apply, without restriction or reserve, to all sales of Products offered by La Savonnerie Marseillaise de La Licorne and made solely on the website https://www.savon-de-marseille-licorne.com with consumers.
They may be printed and kept by the Customer.
Consequently, the fact that the Customer orders a Product offered for sale on the website https://www.savon-de-marseille-licorne.com implies full and complete acceptance of these Terms and Conditions of Sale, which the Customer acknowledges having read prior to ordering.

SML offers the sale of its products on the website https://www.savon-de-marseille-licorne.com to consumers who have the legal capacity to place an order (hereinafter referred to as “Customer”). SML is not obliged to verify the legal capacity of each Customer.
The selling price of the Products indicated in euros is the one in force at the time the order is placed. These prices do not include shipping costs, which are invoiced in addition to the price of the Products purchased in accordance with the terms and conditions defined below and as indicated to the Customer before the order is validated. The prices include the value added tax applicable on the day of the order.
The offers presented by SML are valid as long as they are announced on the site and within the limits of available stocks. Information on the availability of the Products is provided at the time the order is placed, if applicable.
How to order
SML offers the possibility to order in way that is most conveninet for the Customer.
ON THE WEBSITE
The payment is made by credit card via Paypal or by bank transfer or cheque.
The Customer has the possibility to check the details of their order and correct any errors.
From the moment the Customer confirms his/her order by clicking on the “Order” icon, he/she is considered to have accepted with full knowledge of the contents and conditions of the order and in particular the present Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and delivery times of the Products offered for sale and ordered by the Customer.
The sale will be definitive at the moment of the confirmation of the order by the Customer, without prejudice to the exercise by the Customer of their right to cancel the order (the terms of which are described below). This order will be confirmed by SML by sending an e-mail to the Customer containing all the information previously provided by SML.
A second e-mail will be sent to the Customer when the order is dispatched.
SML recommends that the Customer keeps both emails. The Customer is informed that the two e-mails will be sent to the e-mail address entered by the Customer at the time of identification, prior to placing the order. Therefore, in the event of an error in entering the e-mail address concerned, or of non-receipt of the order confirmation e-mail, SML cannot be held responsible.
SML will be entitled to collect the full amount corresponding to the order as soon as the e-mail informing the Customer of the dispatch of the order is sent.

Place of delivery
SML delivers the Products in Metropolitan France (including Corsica and Monaco), as well as in the whole world.
The Products will be sent to the delivery address indicated by the Customer during the ordering process.
The contribution to delivery costs includes all taxes.
Delivery time of the Products
The delivery time is generally less than 6 working days from the receipt of payment. For information purposes, and without SML being bound by this timeframe, the average delivery time is estimated to be 2 to 3 days from the receipt of the shipping confirmation e-mail. The order will be dispatched within 5 days after the payment has been received.
For shipments to Corsica, please allow 1 additional day. For deliveries to other countries, please contact our Customer Service.
Terms of delivery of the Products
STANDARD POST: DELIVERY WITHOUT SIGNATURE
The amount of delivery costs depends on the weight of your order. The recipient can trace their parcel by means of the parcel number that they receives by e-mail or, failing that, through Customer Service.
The parcel is delivered directly to the letterbox at the delivery address.
In the event that the letterbox is insufficient in size, the parcel is delivered either to the recipient of the order, or failing that and at the initiative of La Poste to any other person present at the address who agrees to take delivery (a neighbour, a caretaker or caretaker). In this case, the details of the latter will be indicated on a notice delivered to the letterbox at the address indicated.
When the parcel could not be delivered according to what is mentioned above, a notice of pending delivery is left by La Poste in the mailbox of the addressee indicating the contact details of the Post Office where the addressee will be able to withdraw the parcel within 14 calendar days.
If the recipient does not collect the parcel within the time limit indicated by the Postal Service, the parcel will be returned to our warehouse and the transport costs will be invoiced to the Customer. The Products ordered will either be refunded or reshipped.
In the event of a dispute relating to the delivery itself, the computer system (flashing) of La Poste will be deemed authentic unless the Customer provides proof to the contrary.

LA POSTE COLISSIMO : DELIVERY WITH SIGNATURE (AT THE CUSTOMER’S REQUEST: IN THIS CASE, SEND A SPECIFIC REQUEST BY E-MAIL TO email@example.com)
The amount of delivery costs depends on the weight of your order. The parcel is given to the addressee by the Post Office in exchange for their signature on the delivery note or the acknowledgement of receipt.
The recipient can trace their parcel by means of the parcel number that they receive by e-mail or, failing that, through the Customer Service.
The parcel is handed over personally by La Poste against signature to the addressee, or to the person living with him, or to a person specially mandated. The signature thus digitised is proof of delivery of the parcel.
If the addressee is absent at the address indicated, a notice of pending delivery is left by La Poste in the addressee’s letterbox. This notice indicates the address of the post office where the recipient can collect the parcel within 14 calendar days.
After this period of 14 days, the parcel will return to our warehouse and the transport costs will be invoiced to the Customer. The Products ordered will either be refunded or reshipped.
GLS : HOME DELIVERY
The amount of delivery costs depends on the weight of your order. The parcel will be delivered by GLS against signature and on presentation of an identity document. In the event of absence, the Customer is notified by e-mail of the relay point where the parcel has been put on hold. They have 7 calendar days to collect it.
After this period of 7 days, the parcel will return to our warehouse and the transport costs will be invoiced to the Customer. The Products ordered will either be refunded or reshipped.

When the order is cancelled, SML will reimburse the Customer for the totality of the sums paid, at the latest within fourteen days of the date on which the contract was cancelled.

CONTROL OF THE TRANSACTION
Within the framework of the order control service, SML may contact the Customer by any means, in order to validate a transaction and may, if necessary, request any supporting document deemed useful (relating to identity, and/or domicile and/or the means of payment used). The Customer must provide the required proof within 15 working days of receiving SML’s request.
The Customer is informed that the delay, failure or refusal to provide the requested proofs will result in the cancellation of the order by SML.
Upon receipt of the supporting documents and in the event of confirmation of the order by SML, the delay in transmitting the documents requested by the Client will postpone the delivery of the Product(s) ordered.
RESERVATION OF OWNERSHIP
SML reserves ownership of the Products delivered until full payment of the price.
SML is committed to the proper performance of the obligations resulting from the contract. However, SML may be exempted from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the Client, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure (e.g. strikes, accidents, riots, fire, etc. constituting unforeseeable and irresistible events).
SML cannot be held responsible for any inconvenience or damage resulting from the use of the Internet.
TRANSFER OF RISK
All risk of loss or damage to the goods passes when the Customer or a third party designated by the Customer, other than the carrier offered by the trader, takes physical possession of the goods.

AVAILABILITY OF PRODUCTS
We do our best to ensure the availability of the Products. Product offers are valid as long as they are announced on the site and within the limits of available stocks.
Information on the availability of Products is provided to the Customer at the time of ordering. If a Product in the order is not available at the time of preparation, SML will automatically send an email to the Client.
The Customer can then :
– Replace the out-of-stock Product with a Product of the same amount
– Receive the remainder of the order without the out-of-stock Product, the amount will then be deducted from the order total and will not be charged to the Customer.
– Cancel the entire order.
LEGAL GUARANTEES FOR PRODUCTS
SML respects all its legal obligations of guarantees such as the legal guarantee of conformity provided for in articles L211-4 and following of the Consumer Code and the guarantee for hidden defects provided for in articles 1641 and following of the Civil Code.
In the event of a lack of conformity (goods unfit for the use usually expected of similar goods, which do not correspond to the description given by the seller or which do not possess the qualities announced by the seller or agreed with the Customer) or latent defects (latent defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the Client would not have acquired it, or would only have given a lesser price for it, if he had known about them) of the product and in compliance with the conditions set by the law, the Client must send his complaint in advance to SML by post to the following address SML – 34 cours Julien – 13006 Marseille or by e-mail : firstname.lastname@example.org
In case of lack of conformity, SML will replace the Product with the same or an equivalent product. The replacement will be made within a maximum of 1 month from the reception of the Product.
SML reminds its Customers that SML Cosmetic Products must be kept away from humidity, too high a temperature or too intense a light and may be subject to an expiry date. Cosmetic Products that have not been stored in the above-mentioned conditions will therefore be excluded from the guarantee.
RETURNS AND EXCHANGES
For a return or an exchange, SML invites the Customer to contact Customer Service who will indicate the procedure to follow and will issue a return form to be filled in.
Returns under the right of withdrawal
The Customer has the right to withdraw from this contract without giving any reason within fourteen calendar days.
The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Products.
To exercise the right of withdrawal, the Customer must notify SML – CUSTOMER SERVICE – 34 cours Julien – 13006 Marseille or by e-mail: email@example.com of his/her decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, or e-mail). In order for the withdrawal period to be respected, it is sufficient for the Customer to transmit his communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.
If the customer withdraws from this agreement, SML will refund all payments received from the customer, including delivery costs, without undue delay and in any case no later than fourteen calendar days from the day on which SML was informed of the decision to withdraw from this agreement. SML will make the refund using the same means of payment that the Customer used for the initial transaction, unless the Customer expressly agrees to a different means; in any case, this refund will not incur any costs for the Customer. SML may defer the refund until SML has received the Products.
The Customer must return all the products in the order (except for cosmetic products) to the following address: SML – 34 COURS JULIEN – 13006 MARSEILLE without undue delay and, in any case, no later than fourteen calendar days after the Customer has communicated his/her decision to withdraw from this contract; this time limit is deemed to have been respected if the Customer returns the Products before the expiry of the fourteen day period.
The Customer shall bear the direct costs of returning the Products.
The Customer shall only be liable for the depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Products. All Products must be returned to SML in their original packaging and condition. SML will have a period of four (4) calendar days upon receipt of the returned order to check the condition of the Products. Any damaged product will not be refunded.
For cosmetic Products, and for reasons of hygiene and health protection, the Customer is nevertheless clearly informed that he/she loses his/her right of withdrawal for all cosmetic Products. Indeed, for reasons of hygiene and health protection, the right of withdrawal does not apply to these products.
In the event of a problem, SML invites the Customer to contact Customer Service directly.
Return under the legal guarantees
For a return or an exchange, SML invites the Customer to contact the Customer Service who will indicate the procedure to follow.
Damaged products and reservations
If the parcel arrives damaged or if one or more products are missing, you must, in order to open a claim
- Make reservations with the deliveryman at the time of delivery
- Fill in and send us a copy of the complaint within 72 hours of the delivery date (document to be requested by e-mail or telephone)
- Take one or more photos of the package (contents and packaging
You have 72 hours to provide us with these elements.
Any disputes or litigation that may arise from or in connection with the contract concluded between SML and the Customer may be resolved by mediation/conciliation.
The sale of Products on this site is subject to French law regardless of the country of residence of the Customer or the place of the order. Any dispute relating to the existence, interpretation, execution or termination of a contract between the Customer and SML is subject to the exclusive jurisdiction of the French courts.
CONFIDENTIALITY, PROTECTION OF PERSONAL DATA & RIGHT TO OBJECT TO TELEPHONE SOLICITATION
