These Terms and Conditions of Sale apply, without restriction or reservation, to all sales of Products offered by La Savonnerie Marseillaise de La Licorne and concluded solely on the website https://www.savon-de-marseille-licorne.com to consumers.
They may be printed and kept by the Customer.
Consequently, the fact that the Customer orders a Product offered for sale on the website https://www.savon-de-marseille-licorne.com implies full and unreserved acceptance of these Terms and Conditions of Sale, which the Customer acknowledges having read prior to placing the order.
In accordance with Article L.111-1 of the French Consumer Code, La Savonnerie Marseillaise de La Licorne provides the Customer with the following information:

Customer
SML sells its products on the website https://www.savon-de-marseille-licorne.com Consumers who have the legal capacity to place an order (hereinafter referred to as the "Client"). SML cannot be required to verify the legal capacity of each Client.
RATES
The sale price of the Products indicated in euros is that in force at the time the order is placed. These prices do not include shipping costs, which are invoiced in addition to the price of the Products purchased according to the methods defined below and as indicated to the Customer before the order is validated. Prices include the value added tax applicable on the day the order is placed.
The offers presented by SML are valid as long as they are announced on the site and within the limit of available stocks. Information on the availability of Products is provided when the order is placed, where applicable.

SML offers you the possibility of ordering by the means of your choice, in order to better satisfy you.
ON THE WEBSITE
Payment can be made by credit card via Paypal, by bank transfer or by cheque.
Customers can check the details of their order and correct any errors.
As soon as the Customer confirms his/her order by clicking on the icon " To order", the Customer is deemed to have accepted, with full knowledge of the facts, the content and conditions of the order, and in particular these Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and delivery times of the Products offered for sale and ordered by the Customer.
The sale will be definitive at the time of confirmation of the order by the Client, without prejudice to the exercise by the Client of his/her right of withdrawal (the terms of which are described below). This order will be confirmed by SML by sending an e-mail to the Client containing all the information previously provided by SML.
A second e-mail will be sent to the Customer when the order is dispatched.
SML recommends that the Customer keep these two e-mails. The Customer is informed that both e-mails will be sent to the e-mail address entered by the Customer at the time of identification, prior to placing the order. Therefore, in the event of an error in entering the e-mail address concerned, or of non-receipt of the e-mail confirming the order, SML may not be held liable.
SML will be entitled to collect the full price corresponding to the order as soon as the e-mail informing the Customer that the order has been dispatched has been sent.

Delivery
Place of delivery
SML delivers packages of Products in mainland France (including Corsica and Monaco) and throughout the world.
The Products will be sent to the delivery address indicated by the Customer during the order process.
Delivery costs are inclusive of all taxes.
Product delivery times
Delivery time is generally less than 6 working days from receipt of payment. By way of information, and without SML being bound by this time limit, from receipt of the dispatch confirmation e-mail, the average delivery time is estimated at 2 to 3 days. The order will be dispatched no later than 5 days after receipt of payment.
For deliveries to Corsica, allow 1 extra day. For deliveries abroad, please contact Customer Service.
Terms of delivery of Products
STANDARD POST: DELIVERY WITHOUT SIGNATURE
The delivery charge depends on the weight of your order. The recipient can trace their parcel by means of the parcel number they receive by e-mail or, failing that, via Customer Services.
The parcel is delivered directly to the letterbox at the delivery address.
In the event that the letterbox is of insufficient size, the parcel will be delivered either to the addressee of the order, or failing this and at the initiative of La Poste to any other person present at the address who agrees to take delivery (a neighbour, caretaker or concierge). In this case, the details of this person will be indicated on a notice delivered to the letterbox at the address indicated.
When it has not been possible to deliver the parcel in accordance with the above procedures, a notice of pending delivery is left by La Poste in the addressee's letterbox indicating the address of the Post Office where the addressee may collect the parcel within 14 calendar days.
If the recipient does not collect the parcel within the time indicated by the Postal Service, it will be returned to our warehouse and the transport costs will be invoiced to the Customer. The Products ordered will either be refunded or reshipped.
In the event of a dispute relating to the delivery itself, La Poste's computer system (flashage) will be deemed authentic unless the Customer provides proof to the contrary.

LA POSTE COLISSIMO: DELIVERY WITH SIGNATURE (AT THE CUSTOMER'S REQUEST: IN THIS CASE, SEND A SPECIAL REQUEST BY E-MAIL TO contact@soap-marseille.com)
The delivery charge depends on the weight of your order. The parcel is handed over to the recipient by La Poste in exchange for their signature on the delivery note or acknowledgement of receipt.
The recipient can trace their parcel via the parcel number they receive by e-mail or, failing that, via Customer Services.
The parcel is delivered personally by La Poste against signature to the addressee, or to the person living with the addressee, or to a specially authorised person. The digitised signature is proof of delivery of the parcel.
If the recipient is absent from the address indicated, a notice of pending delivery is left by La Poste in the recipient's letterbox. This indicates the address of the post office where the recipient may collect the parcel within 14 calendar days.
After this period of 14 days, the parcel will return to our warehouse and the Customer will be invoiced for the transport costs. The Products ordered will either be refunded or reshipped.
GLS : HOME DELIVERY
The delivery charge depends on the weight of your order. The parcel will be delivered by GLS against signature and on presentation of proof of identity. In the event of absence, the Customer will be notified by e-mail of the relay point where the parcel has been held. They have 7 calendar days to collect it.
After this period of 7 days, the parcel will return to our warehouse and the Customer will be invoiced for the transport costs. The Products ordered will either be refunded or reshipped.

When the order is cancelled, SML will reimburse the Customer for all sums paid, at the latest within fourteen days of the date on which the contract was terminated.

SML accepts payment by credit card, Visa, Mastercard and American Express.
SECURITY

To increase the security of your bank details, SML does not store them. This is why you will need to provide us with this information each time you place a new order.
SML reserves the right to suspend or cancel any order and/or delivery in the event of non-payment by the Client, a payment incident and/or fraud in the use of the site or the means of payment chosen by the Client.
CONTROL OF THE TRANSACTION
As part of the Order Control Service, SML may contact the Customer by any means with a view to validating a transaction and may, where appropriate, request any supporting documents deemed useful (relating to identity, and/or place of residence and/or means of payment used). The Customer must provide the required supporting documents within 15 working days of receiving SML's request.
The Client is hereby informed that any delay, failure or refusal to send the requested supporting documents will result in the cancellation of the order by SML.
On receipt of the supporting documents and in the event of confirmation of the order by SML, the time taken to send the documents requested by the Customer will postpone delivery of the Product(s) ordered by the same amount.
RETENTION OF TITLE
SML reserves ownership of the Products delivered until the price has been paid in full.
RESPONSIBILITY
SML undertakes to perform its obligations under the contract properly. However, SML may be exonerated from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the Client, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure (e.g. strikes, accidents, riots, fire, etc. constituting unforeseeable and irresistible events).
SML cannot be held responsible for any inconvenience or damage resulting from the use of the Internet.
TRANSFER OF RISK
It is when the Customer or a third party designated by the Customer, other than the carrier proposed by the professional, takes physical possession of the goods that any risk of loss or damage to the goods is transferred.

PRODUCT AVAILABILITY
We do our utmost to ensure the availability of Products. Product offers are valid as long as they are announced on the site and within the limits of available stocks.
Information on the availability of Products is provided to the Customer at the time of ordering. If a Product in the order is not available at the time of preparation, SML will automatically send an email to the Customer.
The Customer may then :
- Replace the out-of-stock Product with a Product of the same value
- Receive the remainder of the order without the out-of-stock Product, in which case the amount will be deducted from the order total and will not be invoiced to the Customer.
- Cancel the entire order.
LEGAL PRODUCT GUARANTEES
SML complies with all its legal guarantee obligations, such as the legal guarantee of conformity set out in articles L211-4 et seq. of the French Consumer Code and the guarantee for hidden defects set out in articles 1641 et seq. of the French Civil Code.
In the event of a lack of conformity (goods that are unfit for the use normally expected of similar goods, that do not correspond to the description given by the seller or that do not possess the qualities announced by the seller or agreed with the Customer) or hidden defects (hidden defects in the item sold that render it unfit for the use for which it was intended, or which so diminish this use that the Client would not have acquired it, or would only have given a lesser price for it, if he had known about them) of the product and in compliance with the conditions laid down by law, the Client must first send his complaint to SML by post to the following address: SML - 34 cours Julien - 13006 Marseille or by e-mail : contact@soap-marseille.com
In the event of a lack of conformity, SML will replace the Product with the same or an equivalent product. The replacement will be made within a maximum of 1 month from receipt of the Product.
SML reminds its Customers that SML Cosmetic Products must be stored away from humidity, too high a temperature or too much light and may be subject to an expiry date. Cosmetic Products that have not been stored under the aforementioned conditions will therefore be excluded from the guarantee.
RETURNS AND EXCHANGES :
For a return or an exchange, SML invites the Customer to contact Customer Services who will indicate the procedure to follow and will issue a returns form to be completed.
1. Returns under the right of withdrawal :
The Customer has the right to withdraw from this contract without giving any reason within fourteen calendar days.
The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Products.
To exercise the right of withdrawal, the Customer must notify SML - SERVICE CLIENTS - 34 cours Julien - 13006 Marseille or by e-mail: contact@soap-marseille.com of his/her decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, or e-mail). In order for the withdrawal period to be respected, it is sufficient for the Customer to transmit his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
In the event of the Customer withdrawing from this Agreement, SML will refund all payments received from the Customer including delivery charges without undue delay and in any event no later than fourteen calendar days from the date on which SML was informed of the Customer's decision to withdraw from this Agreement. SML will make the refund using the same means of payment that the Customer used for the original transaction, unless the Customer expressly agrees to a different means; in any event, this refund will not incur any costs for the Customer. SML may defer the refund until SML has received the Products.
The Customer must return all of the products in the order (except cosmetic products) to the following address: SML - 34 COURS JULIEN - 13006 MARSEILLE without undue delay and, in any event, no later than fourteen calendar days after the Customer has communicated his/her decision to withdraw from this contract. This period is deemed to have been respected if the Customer returns the Products before the fourteen-day period has expired.
The Customer shall bear the direct cost of returning the Products.
The Client is only liable for the depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Products. All Products must be returned to SML in their original packaging and condition. SML will have a period of four (4) calendar days from receipt of the return of the order to check the condition of the Products. Any damaged product will not be reimbursed.
For cosmetic Products and, for reasons of hygiene and health protection, the Customer is nevertheless clearly informed that he loses his right of withdrawal for all cosmetic Products. For reasons of hygiene and health protection, the right of withdrawal does not apply to these products.
In the event of a problem, SML invites the Customer to contact Customer Services directly.
2. Return under legal guarantees
For a return or exchange, SML invites the Customer to contact Customer Service who will indicate the procedure to follow.
SKILLS
Any disputes or litigation arising out of or in connection with the contract between SML and the Customer may be resolved by mediation/conciliation.
Sales of Products on this site are subject to French law regardless of the Customer's country of residence or the place of order. Any dispute relating to the existence, interpretation, performance or termination of a contract concluded between the Customer and SML is subject to the exclusive jurisdiction of the French courts.
CONFIDENTIALITY, PROTECTION OF PERSONAL DATA & RIGHT TO OBJECT TO TELEPHONE MARKETING
Our web server automatically recognises the domain name (of the access provider) and, where possible, the e-mail address of visitors to our site. We centralise domain names for statistical purposes. We use this information to improve the content of the pages on our site.
SML collects and processes personal data concerning the Customer and the recipient of the order (except credit card number) in computerised form for the sole purpose of managing orders. If the General Terms and Conditions of Sale are modified, they will only apply to orders concluded from the date of said modifications.
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

SML is the owner of all intellectual and industrial property rights relating to the Website and the SML brand and holds the related usage rights.
Access to this Website does not give you any right to the intellectual property rights relating to the Website, which remains the exclusive property of SML.
The general structure of the Site, as well as the elements accessible on the Site, particularly in the form of texts, photographs, images (animated or not), icons, maps, sounds, videos, software, databases, data and all other elements making up the Site are the exclusive property of SML.
